Lets get to it;

Hello everyone today is 3/14/2013  2:47:AM  it's been a late night just got off work and usually everytime i
get off work i go straight to sleep.But!!!not tonight,because something just happen to me and i can get it out of my head.so please bare with me and read along as i describe everything.also you can comment and give me some advice it will means alot....so here we go...

Really is my insurance company Screwing me over?

I was insured (third party fire and theft) with Nationwide motor insurance. Whilst on a visit to a friend elsewhere in the country, I was involved in a non fault accident on my part (someone didn't look at a junction and carried straight on, hitting my passenger side as i was driving past said junction) and the damage to my car made it an "uneconomical write off" which, as i understand it, means the car would cost more to repair than it is worth.

I informed my insurance company, and had engineer's sent out to assess the damage to my vehicle, and upon hearing that it was written off, I cancelled my insurance policy. However, it had taken time to get this report, and i had already paid for an extra month's insurance, despite the fact i wasn't driving my car (i pay monthly). What's more, my insurance then demanded i pay the rest of the year as a cancellation fee, bringing my total arrears with them up to over $1000.

The obvious statements; i shouldn't have to pay insurance on a written off car, and i certainly shouldn't have to pay cancellation fees due to a non fault accident.

HOWEVER;

I'm worried, because the engineers report stated that, although my car is an uneconomical write off, it was still road worthy; most of the passenger side of my car was dented in, nobody wants to drive a car in that state, so you can understand why i'd want to get myself a new car, but from a legal perspective, I'm worried that my insurance will justify the charges by saying there's no need for me to cancel the policy, as the vehicle is still road legal.

I'm only 23 and worked my balls off to get myself on the road, and if I get this $1000 charge on my head it'll rinse all of the money i get from my insurance claim and i'll be back to square one again.

What do you guys think?
